
Missives
We will negotiate the price on your behalf – not all solicitors will do that for you. The missives are the contract and we will receive the written acceptance around 10 days after the date of the offer has been accepted verbally. The missives contain the price date of entry and moveable items. Various letters will go back between the solicitors until agreement is reached. We should not conclude a contract until your loan has been approved. Once the contract has been concluded you have a right to purchase and the seller an obligation to sell. If you fail to pay the price and it is your fault, then you will liable to pay compensation to the sellers.
Conveyancing
Usually we will receive the titles with the written acceptance. We will let you have a written report on the titles and ask that you confirm that you are happy with the description of the property. We will raise observations on the titles and ensure that these are answered before the date of entry. We will examine the searches and clarify if there is a factor appointed to look after the common parts. We will draft the title transfer documentation at this point.
Loan
The loan papers should arrive at least two weeks before the date of entry. We will either send you the documentation to sign or ask you into the office to sign the paperwork. At this stage we will forward to you a draft statement which will disclose the amount that you need to pay including the balance of the purchase price and the fees and outlays.
Settlement
We have to ensure that all of the observations are answered and the balance of the purchase price, fees and outlays are paid before the date of entry. On the basis that everything is in place then we will send the purchase price the day before the date of entry. We will call you on the date of entry to confirm that you can go and pick up the keys. Thereafter we will receive the titles and will have these registered in your name. Once the registration process has been completed and the titles returned then we will either forward these to you or send them to your lender.
