
Missives
We will negotiate the price on your behalf – not all solicitors will do that for you. The missives are the contract and we will send you the offer and ask that you contact the office to discuss the terms. The missives contain the price date of entry and moveable items. Various letters will go back between the solicitors until agreement is reached. Once the contract has been concluded you have an obligation to sell and the purchaser a right to buy. If the purchaser fails to pay the price and it is his fault, then the seller will require to pay you compensation.
Conveyancing
Usually we will receive the titles from you or your lender before we receive the offer. We will send the titles to the purchaser’s solicitors and await their observations. We will answer their observations on the titles and ensure that these are answered before the date of entry. We will order the searches and deal with any ancillary matters. The transfer documentation will be prepared by the purchasers and sent to us with their observations on the titles. We will receive the transfer documentation and contact you to come into the office to sign the paperwork or send it to you.
Loan
If you have a mortgage we will have received the amount to repay – the redemption statement. This will allow us to prepare a statement of account which we will send to you before the date of entry. This will show whether you need to send us a payment or not. More than likely we will either be making a payment to you or transferring the balance to the purchase account if you are buying and selling.
Settlement
We have to ensure that all of the observations are answered. On the basis that everything is in place we will wait for the purchase price from the purchaser. You should drop the keys off at the estate agents the day before the date of entry. We will call you on the date of entry to confirm completion, repay your mortgage and if you want us to pay the estate agent. Thereafter we will send the titles to the purchasers and complete the transaction.
